General terms and conditions of use of the website www.mairuna.it and of participation in the programmes of Mairuna – Centro Maternità Evolutiva

This is a courtesy translation. The Italian version is the only legally binding text.


1. Who we are

Mairuna – Centro Maternità Evolutiva is a project shared by three independent professionals, each operating under her own VAT number. Mairuna is not a company and is not a separate legal entity: it is the distinctive sign under which the professionals who belong to it present their activities to the public.

Pursuant to art. 7 of D.Lgs. 70/2003 (Legislative Decree 70/2003, on electronic commerce) and art. 49 of D.Lgs. 206/2005 (the Codice del Consumo, the Italian Consumer Code), we provide the following information:

In the text that follows, "Mairuna" and "we" mean the professionals named above, "you" and "User" mean anyone visiting the website, and "Participant" means anyone taking part in a programme.


2. Subject matter and acceptance

These terms govern:

  • (a) access to and use of the website www.mairuna.it and its content;
  • (b) the sending of requests through the forms on the website;
  • (c) enrolment in our programmes and participation in the related activities.

By using the website you accept the provisions of sections 3–6 and 13–20. By enrolling in a programme you also accept sections 7–12.

If you do not accept these terms, we ask you not to use the website.


3. What this website is (and is not)

The website is for information and first contact.

Nothing is bought on this website. There is no basket, it is not possible to pay online, and no function of the website concludes a contract. The "Request a place", "Waiting list" and "Contact" forms are there to express interest and to open a conversation with us.

The information published on the programme pages — dates, locations, number of sessions, indicative prices — amounts to an invitation to contact us and does not constitute an offer to the public within the meaning of art. 1336 c.c. (the Italian Civil Code). Actual availability of places and the applicable financial terms are confirmed to you by us when we are in touch.


4. Requirements for use

To send a request through the website you must be of age and provide data that is truthful, accurate and up to date.

You undertake not to use the website for unlawful purposes, not to attempt to access restricted areas, not to send bulk or automated submissions through the forms, not to introduce harmful code and not to do anything that could compromise the operation or security of the website.

We reserve the right to restrict or prevent access by anyone who breaches these rules, without prejudice to any other remedy available at law.


5. Service availability

We aim to keep the website accessible and up to date, but we do not guarantee uninterrupted, error-free operation. The service may be suspended for maintenance, updates, faults or causes beyond our control.

We reserve the right to modify, suspend or discontinue the content and functionality of the website at any time, in whole or in part.


6. Website content and intellectual property

All content on the website — text, photographs, illustrations, videos, graphics, trade marks, logos, layout, source code and databases — belongs to Mairuna or to the respective authors and is protected by Legge 633/1941 (the Italian Copyright Act) and by trade mark law.

The sign "Mairuna" and the claim "Ti accompagniamo nel tuo percorso, al passo che sceglie il tuo corpo" are used exclusively by the professionals named at point 1.

You may view, download and print the content for personal, non-commercial use. Any reproduction, distribution, communication to the public, modification or use for commercial purposes without our written consent is prohibited. Ordinary links to the home page and to internal pages are permitted, provided they do not suggest a relationship of cooperation or endorsement that does not exist.

Photographs showing people are published with the consent of those concerned and may not be extracted or reused.


7. How enrolment in a programme works

Enrolment involves four steps:

  1. Request. You send us a request through the form on the website, by e-mail, by telephone or via WhatsApp, indicating the programme, the location and the date you are interested in.
  2. Reply. We get back to you confirming the availability of places and summarising dates, times, location, number of sessions, the professional in charge, the participation fee and any other applicable terms.
  3. Confirmation on your side. You confirm that you wish to take part.
  4. Conclusion of the contract. The participation contract is concluded at our premises, at the start of the programme, upon payment of the fee. Until then you are under no obligation to pay and your position is a booking, which you may cancel freely in accordance with point 9.

Before the programme begins you will receive from us a written summary of the agreed terms (by e-mail or message), which constitutes confirmation on a durable medium pursuant to art. 51 of the Codice del Consumo.


8. Participation fees and payments

Participation fees are communicated before the contract is concluded and are inclusive of all charges; any applicable taxes are shown separately where due.

Payment is made at our premises, at the start of the programme, by the means we indicate to you (cash within the limits allowed by law, debit card, credit card or bank transfer, as agreed). You will receive a proper tax document issued by the professional providing the service.

If the programme allows payment in instalments, the due dates are given to you in writing at the time of confirmation.

Each professional invoices her own services under her own VAT number: the tax document you receive therefore shows the details of the professional in charge of your programme and not an entity called "Mairuna".


9. Cancellations, absences and withdrawals

Since payment is made only at the start of the programme, a cancellation notified before the start involves no cost to you. We do ask, however, that you let us know as soon as possible, because every programme has few places and a late cancellation stops someone else from taking part.

9.1 Cancellation before the programme starts. Let us know that you are withdrawing by e-mail, telephone or WhatsApp with as much notice as possible and, where you are able to, at least two days before the first session. No charge.

9.2 Absence from a session. If you cannot be present at a single session of a programme that has already started, let us know: the fee relates to the programme as a whole and absences do not give rise to any reduction or refund. Subject to the calendar and the availability of places, we will try to offer you the chance to make up the session in a later edition; this is a courtesy and not a contractual obligation.

9.3 Discontinuing the programme on your side. If you discontinue a programme that has already started by your own choice, the fee paid is non-refundable as regards the sessions already held. For sessions not yet held, we will consider together, in good faith, either making them up in a later edition or a proportionate refund.

9.4 Discontinuation for health reasons. If a documented health reason — yours or your baby's — prevents you from continuing, we offer you the chance to make up the remaining sessions in a later edition within 12 months or, if that is not possible, a proportionate refund for the sessions not attended.

9.5 Cancellation or postponement on our side. We may cancel or postpone a programme if the minimum number of participants set for that programme — which we tell you at the time of confirmation — is not reached, or because the professional is unavailable, because the venue is unavailable or for reasons of force majeure. In such cases we let you know as soon as possible and offer you the choice between: moving to a later date, transferring to another equivalent programme, or a full refund of anything already paid. No further amount is due to you on any other basis.

9.6 Changes to the schedule. Minor changes of time, room or professional may prove necessary: we will tell you promptly. If a change substantially alters the programme agreed, you may withdraw at no cost.


10. Consumer right of withdrawal

10.1 When it does not apply. The contract is as a rule concluded at our premises, with you physically present and paying the fee (point 7). It is therefore neither a distance contract nor a contract negotiated away from business premises, and the 14-day right of withdrawal provided for by art. 52 et seq. of the Codice del Consumo does not apply.

10.2 When it does apply. If in a specific case the contract is concluded entirely at a distance — for example with advance payment following an exchange of messages — and you are acting as a consumer, you have the right to withdraw within 14 days of the conclusion of the contract, without giving any reason and without penalty. An explicit statement sent to [email protected] or to the Udine premises is enough; you may use the model form set out in Annex I, Part B, of the Codice del Consumo. We refund you within 14 days of receiving the notice, using the same means of payment you used.

10.3 Early performance. If you expressly ask us for the programme to begin before the 14 days have elapsed and you then withdraw, you owe us an amount proportionate to what has already been provided up to the point at which you notified your withdrawal (art. 57(3) of the Codice del Consumo).

10.4 Exception for activities with a set date. We should point out that art. 59(1)(n) of the Codice del Consumo excludes the right of withdrawal for contracts for services with a specific date or period of performance. Since it is not settled how our programmes fall to be classified under that provision, we choose not to rely on that exception and to grant you the right of withdrawal in any event in the cases set out at point 10.2.


11. Nature of the programmes and health information

11.1 What our programmes are. Mairuna's programmes are activities of accompaniment, education and support for the person at the various stages of reproductive life. They are led by qualified professionals, each within the scope of her own skills and professional rules.

11.2 What they are not. The programmes are in no case a substitute for a medical examination, diagnosis, prescription or treatment and are not an emergency or urgent care service. The information you receive during the sessions, like the content published on the website, is for general information purposes and cannot be construed as personalised medical advice.

For any clinical matter, speak to your own doctor, your gynaecologist or your healthcare provider. In an emergency, call 112.

11.3 Fitness to take part. Some programmes involve physical or bodywork activity. Before enrolling you are required to check with your doctor or with the healthcare professional looking after you that there are no contraindications, and to tell us about any condition relevant to your safety and that of your baby. For certain programmes we may ask you for a medical certificate or a declaration of fitness: if so, we tell you at the time we confirm your enrolment.

11.4 Your duty to inform us. You undertake to tell us promptly of any change in your state of health that could affect your participation. In your own interest, the professional may suspend or modify an activity or ask you to obtain medical advice before continuing.

11.5 Professional secrecy. The information you share with a midwife or another healthcare professional is covered by professional secrecy and processed as set out in the Privacy Notice.


12. Rules of participation

  • We ask you to be punctual and to respect the premises, the equipment and the other participants.
  • Babies and children are welcome at the programmes that provide for their presence; they remain under the supervision and responsibility of the person holding parental responsibility.
  • Companions and partners may attend the sessions that provide for this, by prior agreement.
  • Photographs and recordings. Photographing or filming other participants without their consent is not permitted. If we ourselves take photographs or videos intended for the Centre's communications, we tell you beforehand and ask for specific written consent, which you may withdraw at any time.
  • Teaching materials. The materials we give you are for personal use: they may not be reproduced or circulated.
  • We may remove from an activity anyone behaving dangerously, seriously improperly or harmfully towards other people, with no right to a refund.

13. Liability and insurance cover

We are liable for damage arising from our wilful misconduct or gross negligence and, within the mandatory limits set by law, for failure to perform the obligations we have undertaken. Nothing in these terms limits or excludes liability for death or personal injury resulting from our conduct, nor the mandatory rights granted to consumers by the Codice del Consumo.

The healthcare professionals working at the Centre are covered by professional indemnity insurance on the terms required by Legge 24/2017 (Italian Law 24/2017). On request we will give you the details of the cover applicable to the service concerning you.

To the extent permitted by law:

  • we are not liable for damage arising from use of the website's content in a manner inconsistent with point 11, nor from decisions taken on the basis of general information;
  • we are not liable for your failure to comply with the obligation to check your fitness to take part or to inform us about your state of health;
  • we are not liable for the loss of or damage to personal belongings left unattended at our premises;
  • we are not liable for the content of third-party websites reachable through links on the website, over which we have no control.

14. Reviews, testimonials and user content

The testimonials published on the website come from people who have actually taken part in our programmes and are published with their consent; they may be shortened for reasons of space, without altering their meaning.

We do not publish false testimonials or testimonials from people who have not taken part, in accordance with art. 21 and art. 22 of the Codice del Consumo as amended by D.Lgs. 26/2023.

If you send us content (a text, a photograph, a review) and authorise its publication, you grant us a free, non-exclusive licence to use it on our channels; you may withdraw that licence at any time by writing to us, and we will remove the content.


15. Newsletters and communications

Subscribing to our newsletters is free and optional and works by double opt-in: the subscription is only completed after you have clicked the confirmation link in the e-mail we send you.

You may unsubscribe at any time through the link in every message or from the preferences page, with no consequences whatsoever for your ability to take part in the programmes.

16. Privacy and cookies

The processing of your personal data is described in the Privacy Notice. The use of cookies and measurement tools is described in the Cookie Policy. You can change your choices at any time through the "Manage cookies" link at the bottom of every page.


17. Accessibility

We design the website aiming at the WCAG 2.1 level AA criteria. If you come across a barrier that prevents you from accessing content or completing an action, write to us at [email protected]: we will act as soon as we can and, in the meantime, provide you with the information or the service through an alternative channel.


18. Changes to these terms

We may amend these terms to reflect legal, technical or organisational changes. The version in force is always published on this page with the date of the last update.

Changes do not apply to programmes already confirmed, which remain governed by the terms in force at the time of confirmation.


19. Governing law, complaints and dispute resolution

These terms are governed by Italian law.

Complaints. Before taking any other step, we invite you to write to us at [email protected]: we reply as quickly as possible and in any event within thirty days, seeking a shared solution.

Jurisdiction. If you are acting as a consumer, the courts of the place where you are resident or have elected domicile have exclusive jurisdiction (art. 66-bis of the Codice del Consumo). If you are acting in the course of a professional activity, the Court of Udine has exclusive jurisdiction.

Alternative dispute resolution (ADR). As a consumer you may use the mediation and conciliation procedures provided for by art. 141 et seq. of the Codice del Consumo, by applying to an ADR body listed in the register kept by the Ministero delle Imprese e del Made in Italy (the Italian Ministry of Enterprise), or to joint conciliation at the competent Chamber of Commerce. Recourse to those procedures is optional and does not affect your ability to bring proceedings before the courts.


20. Final provisions

If any provision of these terms should prove void or ineffective, the remaining provisions retain full validity.

Our tolerance of a breach does not amount to a waiver of the right to rely on it in the future.

The Italian-language text is the only binding version of these terms. This English text is a courtesy translation provided for ease of reading: in the event of any discrepancy or difference in interpretation, the Italian version prevails.
